Man pleads no contest to hitting baby daughter

BILLINGS, Mont. (AP) ? A 36-year-old Billings man has pleaded "no contest" to hitting his baby daughter on Father's Day 2012 because she was crying.

The Billings Gazette reports Robert Kenneth Decoteau told District Judge G. Todd Baugh on Monday that he would not contest a felony charge of assault on a minor.

The plea means he does not admit or dispute the charge, but the court treats it like a guilty plea.

Decoteau was arrested on June 17 after police responding to a disturbance heard a child crying. Officers found Decoteau holding his 10-month-old daughter, who had blood on her face.

Several other children in the home told officers that Decoteau was intoxicated and hit the girl because she was crying.

Sentencing is set for March 4.

MONTANA POLICE SHOOTING

Chief: Shooting of patrol car thief justified

BILLINGS, Mont. (AP) ? The chief of the Billings Police Department says an officer was justified in shooting a burglary suspect who was killed as he attempted to steal a patrol car following a standoff.

Chief Rich St. John said Tuesday the officer feared for his life after 29-year-old Daniel Brawley slipped out of his plastic handcuffs, climbed into the front seat of a patrol car and knocked the officer to the ground as he sped away.

Officer Dave Punt fired nine times through the side and rear of the vehicle, hitting Brawley once in the torso.

A coroner's jury will have final say on whether Punt's actions were justified.

The cause of death remains pending, and it's unclear if Brawley died Jan. 6 from the gunshot or when he crashed the patrol car.

STILLWATER MINING

Mont. precious metals miner reports production dip

BILLINGS, Mont. (AP) ? A Montana mining company says its palladium and platinum production dropped slightly in 2012 but is poised to pick up in coming years with a planned expansion.

Billings-based Stillwater Mining Co. said Tuesday it produced 513,700 ounces of the precious metals in 2012. That exceeds the company's earlier expectations, but was about 4,000 ounces lower than 2011 production.

Stillwater also recycles the metals, which are used in catalytic converters for cars, jewelry and for industrial purposes. Recycling volumes dipped about 41,000 ounces in 2012 to 445,200 ounces.

The company says the first of two planned expansions could begin producing by late next year, with 75,000 ounces of new production annually by 2017.

Stillwater shares were trading up 20 cents, or about 1.4 percent, to $13.90 Tuesday afternoon on the New York Stock Exchange.

MEDICAL MARIJUANA-RAIDS

Prosecutor recommends 10 years for ex-pot provider

HELENA, Mont. (AP) ? A prosecutor is recommending 10 years in prison for a former medical marijuana provider who struck a plea deal after he was convicted on eight drug and weapons charges.

Assistant U.S. Attorney Joseph Thaggard says in his sentencing memo Chris Williams should serve consecutive five-year sentences for the two charges to which he pleaded guilty.

Williams is facing a mandatory minimum sentence of five years, which is what his attorney is requesting from U.S. District Judge Dana Christensen.

Williams will be sentenced Feb. 1 for his role as head of Montana Cannabis' Helena greenhouse.

Montana Cannabis was among the marijuana providers raided in a 2011 federal crackdown.

Williams decided to go to trial but made a deal after the jury's verdict left him facing at least 80 years in prison.

OFFICER ASSAULT CHARGE

Man charged with trying to hit police car

GREAT FALLS, Mont. (AP) ? A 25-year-old Great Falls man faces several charges after police say he tried to back his pickup truck over a patrol car.

KFBB-TV reports James Verhoeven made an initial court appearance Monday on charges including felony assault on a peace officer and misdemeanor driving under the influence.

Court records say police tried to stop a pickup truck that drove off after apparently being high-centered on snow in the middle of the street on Saturday. The pickup pulled into a parking lot and the officers pulled in behind it. Prosecutors allege Verhoeven tried to back his truck into the patrol car at a high rate of speed.

Officers moved the car out of the way and blocked Verhoeven's vehicle from leaving. He then attempted to run away and was arrested.
